Accesing and using byNotes, as well as using any of the services provided under the domain bynotes.com implies the acceptance of this terms. I, Alberto García Hierro, the current developer, maintainer and administrator, reserve the right, at my sole discretion, to modify these terms at any given time without prior notification for the purpose of enhancing the service.

Violation of any of these terms implies a temporal or (most likely) permanent ban.

Your obligations as user

As a byNotes user you agree on not using the site for:

1. Insulting or intimidating any of the users
2. Sending difamatry, racist, pornographic, offensive or explicit violence contents
3. Spreading private information
4. Submitting spam to the site or other users of the site
5. Advertising or soliciting to buy or sell any products or services
6. Registering more than one account
7. Impersonating other people
8. Spreading viruses, adware, worms or any type of malware

Furthermore, when you send a note with a file attachment, you acknowledge you have the rights to distribute it and you grant byNotes unlimited permission to redistribute it.

Discharge of Responsibility

The administrator at byNotes cannot guarantee the reliability, legality nor the utility of the contents. Linking to other site doesn't imply any relationship between the administrator at byNotes and any third parties administering the linked site. The administrator at byNotes assumes no responsibility for the linked sites, nor can control the reliability, legality nor the utility of their contents. The users are responsible for the notes, links and files they submit to the site, so the administrator at byNotes assumes no responsibility for them.

About the information you provide to us

The only information we request is a valid email address, because that's the only way of resetting your password in case you forget it. We will never publish nor share this email address.

There are also other data you can optionally provide to us using your settings. This is information is, unless you opt out, publicly available in your profile. You can edit or delete this data at any time from your settings.

When you tell us where you are, you can choose who is able to view it and how. By default, people in your friend list can see your location within a radius of 2.5 kilometers (1.55 miles), while the rest of the users (included unregistered ones) can see it at the third administrative division level, but you can change this parameters at any time. You can also choose to share this data with other parties trough our API.

In compliance with Spanish Organic Law 15/1999, from December 13th, about Personal Data Protection (Ley Orgánica de Protección de Datos - LOPD), the administrator at byNotes informs you about the existance of a file registered to its name, containing all the data related to the website users. Data owners can exercise their rights for accessing, rectifying or cancelling this data by editing their settings as well as sending a request to our contact address.

About the data we collect

The information we collect includes IP addresses, cookies and the page you requested, as part of our servers logs. We will only use this data for problem diagnosis or traffic analysis.
